Employers have an obligation to make certain their employees are properly trained to do the job. In this instance, proper and full training in forklift management may well have avoided a death. Trained forklift operators know not to leave a load hanging, even by a small amount, when they leave the controls. They know not to work under any type of unsecured load, because any machine can suddenly fail. They know not to stand under a load to access the forklift controls. And they know the basics of good forklift maintenance, and how to recognize an unsafe condition.

In this instance, a training course and a regular machine maintenance schedule may have saved a life. The Hyster forklift, idle for four years, had mechanical defects that would have been identified in a mechanical checkup. The slack lift chain would have been noticed by someone with full and complete forkilft training.
